The withdrawal of ill-conceived restrictions on livestock trade is welcomeGood sense appears to have prevailed at last. With a fresh set of draft rules to replace last year’s poorly conceived ones, the Centre has sought to withdraw the ban on sale of cattle for slaughter in animal markets. The draft rules are now open for comments and suggestions. When the Union Ministry for Environment, Forests and Climate Change notified the rules under the Prevention of Cruelty to Animals Act on May 23, 2017, there was concern that in the name of preventing cruelty to animals and regulating livestock markets the government was surreptitiously throttling the cattle trade and furthering the BJP’s cow protection agenda. The rules were criticised for restricting legitimate animal trade and interfering with dietary habits. The new draft makes a welcome departure from the earlier rules, seeking to provide great relief to buyers of animals from cumbersome paperwork and procedural requirements. Some distance-specific conditions to curb inter-State and cross-border movement of animals are to be dropped, as also rules barring animal markets within 25 km of a State border and 50 km of the international boundary. The definition of ‘animal markets’ will no more include any lairage adjoining a slaughter-house, thereby removing curbs on the sale of animals in a resting place in the vicinity of a market. The draft retains good provisions in the earlier notification barring cruelty in the treatment and transport of animals.The notification had set off a storm last year, with some Chief Ministers stridently opposing it on the ground that regulating livestock trade was essentially a State subject. Even assuming that the Centre had jurisdiction under the law against animal cruelty to notify the rules, it was obvious that only the States could enforce them. With the Supreme Court expanding a stay granted by the Madras High Court into a nation-wide bar on the rules, and some States taking a clear stand that they would not implement the regulations, the notification was a non-starter. There was further concern whether the regulations would adversely impact poor villagers, as animal markets are predominantly in the countryside. There was an impression that under the guise of stiff regulations, the Centre was making it impossible for cattle, a term that covers cows, buffalo, bulls and camels, to be slaughtered even for food, despite the PCA Act recognising explicitly that animals can be food for humans. The meat trade, valued at thousands of crores of rupees, would have suffered a serious setback had the rules been implemented. Any transformation from a tendency to advance pet causes to an approach based on economic and legal considerations would be a welcome change. The Centre cannot continue to evade its legal obligation to create a mechanism to implement the Supreme Court’s final verdict in the Cauvery dispute. This was the broad message conveyed by the court on Monday when it admonished the government for failing to frame a scheme within the six-week time limit given earlier. For the Centre, it was embarrassing to be asked to demonstrate its bona fides by submitting a draft scheme for the court’s consideration by May 3. The court’s frustration was evident, as the Bench headed by the Chief Justice of India was surprised and disappointed that the Centre had not put a scheme in place or sought an early clarification. It is obvious that a decree on the sharing of water requires a mechanism to give effect to it. It is an evasion of responsibility on the Centre’s part to set off a round of litigation just to determine the nature of such a mechanism. At the same time, it is easy to understand the reluctance of the Bharatiya Janata Party-led government at the Centre. It clearly fears that framing a scheme may adversely affect its prospects in Karnataka, which goes to the polls next month. In the conflict between duty and electoral considerations, the BJP has chosen the latter.  It is a matter of satisfaction that the apex court has indicated that it will pass a binding order soon. The Centre should redeem itself by complying with the latest order. Meanwhile, the ambiguity over whether ‘scheme’ refers to or differs from the ‘Cauvery Management Board’ envisaged in the Cauvery Tribunal’s order has caused great disquiet in Tamil Nadu. This raises the question whether the court should have allowed an element of ambiguity in its judgment by referring to a ‘scheme’, while not expressly modifying the portion of the Tribunal’s order that talks of a ‘Cauvery Management Board’ and a ‘Cauvery Water Regulation Committee’. This is why even the court’s appeal for peace has not assuaged sentiments in Tamil Nadu, where tempers are soaring in some quarters. Unfortunately, a fringe has taken centre stage, focussing almost their entire protest on the Indian Premier League tournament. As a political tactic, threatening a hugely popular cricket tournament is bound to attract national attention. If this is what some of the protestors wanted, then they have succeeded in their objective, even if this has come at the cost of some disruption. However, targeting the IPL is irrational. If the premise is that fun and entertainment are inappropriate in this time of crisis, why pick on one tournament alone? Moreover, IPL matches have nothing to do with the Cauvery dispute; more importantly, they have nothing to with either the Centre or the State. Tele - Law Scheme

The Tele-Law Scheme was launched by the Government of India in order to empower the marginalised sections in rural India. The pilot project is undertaken by the Ministry of Law and Justice in association with the Ministry of Electronics and Information Technology (MeitY). MeitY anchors the Digital India programme, to provide legal aid services through its Common Service Centres (CSCs) at the panchayat level, established across the country. During the first phase, the scheme will be launched in the states of Bihar and Uttar Pradesh at the Panchayat level. It will eventually be introduced on a national scale. Under the programme, assistance will be provided by trained volunteers to the residents in the rural areas, who would help them reach the legal experts through video conferencing through 500 Common Service Centres. A Para Legal Volunteer (PLV) would be the first point of contact for the people in these rural areas. He/she would connect the villagers to the lawyers located elsewhere in the state. 1000 women Para Legal Volunteers (PLV) would be trained to promote women entrepreneurship, empowerment and participation. The advice and counselling to the applicants will be provided by a panel of lawyers at the State Legal Services Authority. These centres shall also be connected to the NGOs working on legal aid, voluntary service providers, District Legal Service Authorities and the law school clinics. In order to keep a check on the quality of legal advice being provided and the ensuing benefit to the people accessing it, a robust monitoring and evaluation system is also being designed.  This scheme is a continuation to the Access to Justice Project for Marginalised Persons, which is being implemented by the Department of Law and Justice and the United Nation Development Programme since 2008. #FancyJ
